What is the difference between separation and divorce?

Separation suspends some of the obligations of marriage without ending it, whereas divorce dissolves the marriage for good and allows you to remarry. As a rule you separate first, and once the period set by law has passed you can then apply for divorce.

What is the difference between a consensual and a judicial separation?

In a consensual separation the spouses agree on the terms — the children, the home, maintenance — and the agreement is then put before the judge; in a judicial separation, where there is no agreement, the court decides. The consensual route is usually quicker and less adversarial, but it depends on the case.

How long does it take to get divorced in Italy?

After a consensual separation, divorce can be applied for once six months have passed; after a judicial separation, the wait is twelve months. The actual timing then depends on the court and on how complex the situation is.

How does child custody work in Italy?

In Italy custody is normally shared between both parents, because the law protects the child's right to a relationship with each of them; sole custody is the exception. The time the child spends with each parent and the contribution to their maintenance are then settled.

How is maintenance (assegno di mantenimento) decided?

Child maintenance is owed by both parents in proportion to their income and takes account of the child's needs and the time spent with each of them. Any maintenance for a spouse depends instead on each person's financial situation and is assessed case by case.
